SC begins live-streaming of proceedings in constitutional cases

NEW DELHI, Sept 27: The Supreme Court began live-streaming of court proceedings on Tuesday. The hearings gone live are constitutional cases. They are initially streamed live on YouTube. The apex court will later develop its own platform to host the live streaming of proceedings.

There were three benches hearing constitutional cases on the day. These cases were petitions challenging the constitutional validity of the 10% reservation for the Economically Weaker Sections (EWS) (court 1), the question of powers of the Delhi Government vis-a-vis the Centre and the petitions by Shiv Sena factions (court 2) and the challenge to the validity of the All-India Bar Examination (court 3).

The bench hearing the petitions challenging the 103rd Constitutional Amendment which introduced 10% reservation for EWS reserved its judgment. The 5-judge bench comprised of Chief Justice of India UU Lalit, Justices Dinesh Maheshwari, S Ravindra Bhat, Bela M Trivedi and JB Pardiwala.

The bench headed by Justice DY Chandrachud was hearing the petitions filed by the Shiv Sena factions led by Uddhav Thackeray and Maharashtra Chief Minister Eknath Shinde each claiming to be the real Sena. The bench will deal with issues of defection, merger and disqualification relating to the 10th schedule of the Constitution.

The third bench was headed by Justice Sanjay Kishan Kaul, hearing the challenge to the All India Bar Examination, a post-enrolment examination for lawyers.

Other cases being listed for live-streaming later are the Bohra community's right to excommunicate, adequacy of Bhopal Gas Tragedy compensation, retrospective application of immunity against arrest etc.

A full court headed by the new CJI had recently decided to live-stream proceedings of all Constitution bench hearings from September 27. Although four years ago, Justice Dipak Misra had, on September 27, 2018, delivered a landmark judgement (Swapnil Tripathi judgment) favouring live telecast or webcast of important proceedings in matters of constitutional importance. The proposal had originally come from senior advocate Indira Jaising to live-stream important case hearings, especially those being heard by Constitution benches.
