NEW YORK CITY, June 11: A senior lawyer has come under a cloud in the Manhattan
federal court following submission of fake legal documents fabricated by ChatGPT,
an artificial intelligence tool, in connection with a compensation case against
Colombian airline Avianca. The judge has ordered action against the lawyer and
his senior attorney, which may include sanctions and even disbarment.
Steven A Schwartz cited over half a dozen previous similar cases and judgements
"hallucinated" by ChatGPT in his filing to support his client Roberto Mata's
case. Mata had suffered an injury on his leg from a metal serving cart in a
flight in August 2019 from El Salvador to New York.
Mata's lawyer was producing precedents, which is a normal course that makes
arguments easy and strengthens one's case, in response to Avianca's attorneys'
plea to judge P Kevin Castel to dismiss the lawsuit because the statute of limitations
had expired. Usually lawyers undertake a laborious research by scanning through
stacks of court documents to get such judicial decisions. But ChatGPT "hallucinated"
legal cases that did not exist.
Some of the nine fake cases and judgements the Artificial Intelligence tool
fabricated as supporting precedents were Petersen v. Iran Air, Varghese v. China
Southern Airlines and Shaboon v. Egyptair.
Schwartz and his senior, Peter LoDuca, who produced the documents without checking
them in the court, where the former has no licence to enter, face judicial sanction
and disbarment.
The judge has ordered action against the lawyer and his senior.
The New York-based lawyer apologised to the judge on Thursday. "I simply had
no idea that ChatGPT was capable of fabricating entire case citations or judicial
opinions, especially in a manner that appeared authentic," Schwartz said. He
said he "greatly regrets" depending on the chatbot and was "unaware that its
content could be false". But that will not end the matter.
The anomaly came to light when Avianca's attorneys and the judge searched for
the cases but could not find any. Thereupon, Schwartz admitted that he had
sought help from ChatGPT and the Artificial Intelligence tool brought up (manufactured or generated) the cases.
According to BBC, some attached screenshots show the conversation between Schwartz
and ChatGPT:
Schwartz: "Is Varghese a real case" (in Varghese v. China Southern Airlines)
ChatGPT: "Yes."
The judge said, "Six of the submitted cases appear to be bogus judicial decisions
with bogus quotes and bogus internal citations ... legal gibberish."
A humiliated Schwartz said, "At the time that I performed the legal research
in this case, I believed that ChatGPT was a reliable search engine. I now know
that was incorrect." He said it was not his intention to mislead the court.
He was trying the OpenAI tool for the first time. In the June 8 filing he
also said he “did not understand it was not a search engine, but a generative
language-processing tool.” In his apology he stated that he learnt it from his college-going children. Schwartz is an associate at the law firm, Levidow & Oberman, and
has been practising law in the city for the last 30 years.
ChatGPT arrived like a storm late last year in November, promising to revolutionise
the search, but is encountering serious concerns in the real world. It was said
that the bot, unlike the search engine, could generate contents like a human
brain. Later, Google’s Bard followed. However, these bots can obviously deploy
algorithms only on existing databases (as of 2021) accessible to them.
The algorithm follows a statistical language model analysing billions of bits
of data looping from existing databases all across the net to logically sequence
them and generate contents, images and calculations and what not in a billionth
of a second! That is why OpenAI has named its bot as Generative Pre-Trained
Transformer (GPT).

After reaching New York, the Cessna made a hairpin turn and flew back over

What next: His fingerprints and mugshot will be taken like any defendant in
criminal cases. Arrest is unlikely (Florida Governor can block any warrant,
complicating matters). Trump's attorney Tacopina said Trump will turn himself
in.
Can Trump contest presidential election? Yes. There is no existing US
law to bar him. He can even serve as President from prison.
The loophole: The Grand Jury has no documentary evidence as the NDA
was not signed either by Trump or Cohen (Trump's attorney who turned hostile) on his behalf. It is depending on the testimony of Cohen and Daniels.
Where do Republicans stand: At any rate, the 'stormy petrel' has cooked
Donald Trump's presidential goose, although he thinks otherwise. The Republicans
are a divided lot.
