Radhe Maa's anticipatory bail plea rejected
MUMBAI: A court here on Thursday dismissed the anticipatory bail plea of controversial godwoman Radhe Maa, accused of complicity in a dowry harassment case involving one of her devotees. Earlier, the police had summoned her to record her statement on Friday. She has sought time till August 25 and police reply is yet to come.

Her devotee Nukul Gupta of Borivali and his relatives had been Radhe Maa's devotees for quite long and Nukul's love marriage was with the godwoman's permission, it is said. After the marriage, Nikki was visiting the ashram at the instance of her in-laws. Nikki alleges the godwoman was controlling the domestic affairs and she did not have much freedom and that she was also abused at the ashram by forcing her to do menial jobs.

Judge VA Raut of the sessions court passed the order after hearing arguments from the defence, prosecution and the advocate of complainant Nikki Gupta. The court asked Radhe Maa to first get her statements recorded by the police.

Nikki had filed the FIR against her husband Nakul Gupta and his five other family members and Radhe Maa at the Kandivali police here. Nikki alleged that her in-laws had been harassing her for dowry at the instigation of the godwoman.

Radhe Maa's arguments that the allegations were baseless and vague were rejected. Her counsel argued that the estranged couple was married in April 2012 and the domestic disputes were running for years and as such there was no proof of any immediate provocation.She said she apprehended arrest since she had been summoned by the police on Friday.

“The complainant has made allegations only to ventilate her frustrations and dejection for being unsuccessful in securing a favourable order from the family court,” Radhe Maa’s submitted before the court.

Nikki's lawyer Sunny Waskar sought Radhe Maa's custodial interrogation as he alleged that there were other crimes indulged in by the godwoman.

The police had summoned Radhe Maa on Friday to record her statements. However, she has sought time until August 25 claiming prior engagements.

One legal view holds that she can be arrested if she fails to appear before the police on Friday.

However, the anti-dowry provisions do not have third parties in its purview. Only the husband and in-laws can be proceeded against.

Meanwhile, sources say the Maharashtra Prevention and Eradication of Human Sacrifice and other Inhuman, Evil and Aghori Practices and Black Magic Act can be invoked against the godwoman.

"Complaints were submitted by lawyers Falguni Brahmbhatt and Ashok Rajput. We are examining the legality and the applicability of the black magic law," a news report quoted the police.

Among the opinions doing the rounds is she can be charged under extortion laws too.

COMMENT: All this amounts to the public, the police and the legal community looking for some legal alibi under which she can be booked. What for? Implicate her is the priority. And still searching to discover crimes the godwoman might have committed. We forget every one has right to his/her space. The godwoman, in this cae, has not trespassed anybody's premises. Have we gone mad?
