Johnson & Johnson offers $9 billion to settle talc powder cancer suits

There are currently over 60,000 lawsuits against Johnson & Johnson over its cancer-causing talc powder. It had been selling the baby powder for the last 130 years. Last year it said it was ending sales globally. Cornstarch is now replacing talc, the carcinogen.

NEW BRUNSWICK (New Jersey), April 6: US pharmaceuticals and consumer goods major Johnson & Johnson has agreed to pay $8.9 billion to settle lawsuits running into tens of thousands that alleged its talcum-based baby powder caused cancer. The company initially had set aside $2 billion for litigation costs in October 2021. The latest offer is to resolve all current and future claims.

"All current and future talc claims" will be covered by the settlement, the New Jersey-based company said in a statement on April 4. It will take care of claims that will come up until the next 25 years.

There are over 60,000 lawsuits against the company over talc powder currently. It has won a large number of cases except when it was awarded to pay $4.7 billion in damages in 2019 to a group of 22 women who had claimed the talc caused them ovarian cancer. Later the amount was reduced in appeals to $2.1 billion.

The customers claimed it contained trace amounts of known carcinogen asbestos.

Due to the litigation the production and sales of its signature talc-based baby powder in the United States and Canada ground to a halt in 2020. It claimed that sales declined mainly because of change in consumer habits.

Johnson & Johnson issued a voluntary recall of baby powder produced and distributed in 2018 after a US Food and Drug Administration (FDA) tested positive for the carcinogen. The company stopped using talc in baby powder and started using cornstarch.

Thousands of cases had been filed against the company complaining its talcom powder caused ovarian and mesothelioma cancers. The latter type affects lungs, abdomen and heart.

However, Johnson & Johnson said the settlement is not an admission that its product caused cancer. It is not "an admission of wrongdoing, nor an indication that the company has changed its longstanding position that its talcum powder products are safe."

A company spokesperson said settlement was preferred as otherwise the litigation would take decades and inflict heavy legal expenses.

Erik Haas said, "Resolving this matter through the proposed reorganization plan is both more equitable and more efficient, allows claimants to be compensated in a timely manner, and enables the Company to remain focused on our commitment to profoundly and positively impact health for humanity."

Once a prosecutor had said, "They could have protected customers by switching from talc to cornstarch, as their own scientists proposed as early as 1973. But talc was cheaper and petitioners were unwilling to sacrifice profits for a safer product."

What is talcum:

Talc, or talcum, is a clay mineral composed of hydrated magnesium silicate. It is used in baby powder, ceramics, paints and roofing materials. Asbestos is also a naturally occurring silicate mineral like talc but it is said to cause cancer.

The terminations are part of a large-scale exercise going on all across Fed departments and organisations to reduce wasteful Government expenditure as decided by a Trump in a mess gone berserk, and improve administrative efficiency following the whims of billionaire and his associate Elon MusK and his DOGE. It has not been shared how terminations are going to raise the efficiency bar! It looks like Trump has stolen some of the prescriptions meant for India. But the American problems are quite different.
