Apex court clears 10 Bills withheld by Tamil Nadu Governor; Clarifies Art 200; "Big victory for all States"

NEW DELHI, Apr 8: The Supreme Court ruled on Tuesday that a Governor cannot
withhold Bills passed by a State Assembly and sent to him/her by the Government
of the State for approval.
A bench of Justices JB Pardiwala and R Mahadevan ordered that the 10 Bills
withheld by Governor of Tamil Nadu RN Ravi shall be deemed to have been cleared
from the date they were re-presented to him after reconsideration by the Assembly.
The apex court also declared withholding of the Bills by Ravi as illegal. The
Governor must assent to a Bill when it is presented to him after reconsideration
by the State Assembly, it said.
"Action of Governor to reserve the 10 Bills for President is illegal and arbitrary
and thus the action is set aside. All actions taken by the Governor thereto
for the 10 Bills is set aside. The 10 Bills shall be deemed to be cleared from
the date it was re-presented to the Governor," the bench stated.
The highest court was giving the verdict in a case filed by the Tamil Nadu
Government against the Governor not giving assent to Bills passed by the Assembly
and withholding them indefinitely. The State sought a timframe for the Governor's
actions in future which was granted.
The Governor, the court said, should have cleared the Bills when they were
re-presented to him after being passed by the Assembly again.

Timeframe for Governor's consent
"Whenever a Bill is presented to the Governor, he is under a constitutional
obligation to adopt one of the three courses of action available," the court
said:
In case of withholding assent and reserving it for President with aid and advice
of Council of Ministers, maximum time one month; If withholding assent without
aid and advice of the Council of Ministers, the Bill must be returned within
3 months; and, if the Bills are re-presented after reconsideration by the Assembly
as desired by the Governor, he must give assent within one month.
Article 200 of the Constitution
Article 200 of the Constitution states the powers and duties of the Governor
in dealing with Bills passed by the Assembly and sent to him for his assent.
The Governor can give his assent, send it back to the House for reconsideration
of any provisions or reserve it for consideration by the President.
If a Bill, sent back to the Assembly without consent, is presented to the Governor
after reconsideration by the Assembly, he/she is bound to clear it within a
month, the apex court ordered.
The apex court also set time frames for the Governor for the consideration
of the Bills presented to him by the State Government.
"All actions of the Governor must align with the principle of parliamentary
democracy," the court said.
Moreover, any action of the Governor under Article 200 is amenable to judicial
review, it said.
Governor vs. State
Ravi is a former IPS officer who had worked at the Central Bureau of Investigation
(CBI). He assumed the office of the Governor in 2021. From the very beginning,
there has been confrontations with the State Government, with Stalin accusing
him of working like a BJP agent, and the latter blocking Bills passed by the
Assembly a dozen times. The ding-dong battle continued.
Last year the Governor walked out of the customary address to the Assembly
as the National Anthem was not played and instead the State anthem Tamil Thai
Valthu was played. In 2023, Ravi refused to deliver the customary address to
the Assembly as he had objections to portions of the draft. On another occasion
he refused to read parts of the speech containing names like BR Ambedkar, Periyar,
CN Annadurai, the words 'Dravidian Model' etc.
Recently the State Government approached the Supreme Court over Ravi withholding
Bills passed by the Assembly indefinitely and not giving consent.

PROGNOSIS: It looks a Real New Trump is emerging - courageous, balanced, powerful and disinterested. THE AMERICAN CONUNDRUM: Political venom has migrated to top echelons in the US. It was reported last year NASA has become politicised, vitiated. But NASA refuted the charge. The terminations are part of a large-scale exercise going on all across Fed departments and organisations to reduce wasteful Government expenditure as decided by a Trump in a mess gone berserk, and improve administrative efficiency following the whims of billionaire and his associate Elon MusK and his DOGE. It has not been shared how terminations are going to raise the efficiency bar! It looks like Trump has stolen some of the prescriptions meant for India. But the American problems are quite different.

OPINION: A nutty 'new' Trump must know checking illegal immigration is his job and not theirs. And 'penalty' tariff is not a solution. However, Trump talking about "major threat" from "illegal aliens" (illegal immigration) is about what he believes, right or wrong, and to that extent he is genuine and honest; it is certainly not a pretension to prop up his political relevance. Bullies are always true to themselves. Look at India's crooked politicians shouting day in, day out to prove they are more patriotic, and to whip up public sentiments for them to ride on!
