Get rid of the Green Card country cap, Indian lobby asks Biden
Let's Go! The legal immigrants should be allowed the flexibility
to change jobs and travel without obstacles. Doing away with the country cap
on Green Cards only can do this easily.
Bureaucratic delays in the US legal immigration system are also a drag on
the country's economy while leaving so many families in limbo, the Congressmen
argued.
In fact, the country cap was introduced to ensure diversity of immigrants
as well as to prevent monopoly by any one country like China leading to distortions
in the American culture and politics in course of time.
In any which case, it is high time the US straightened its convoluted immigration
laws for their own convenience and to allow the immigrants their basic rights!
WASHINGTON, July 30: A group of US Congressmen has appealed to President Joe
Biden to scrap the country cap on Green Cards which is causing huge backlog
of applicants waiting for decades.
In their letter to Secretary of State Antony Blinken and Department of Homeland
Security Secretary Alejandro Mayorkas, a bipartisan group of 56 US Congressmen
has requested the Biden administration to take executive action to make Green
Card priority dates current for applicants from India in order to reduce the
195-year-long wait period which has created perpetual uncertainty about their
future.
By using its authority under the existing law, the administration can ease
this burden while strengthening the economy and helping to create jobs, they
argued.
They requested the administration to mark visa bulletin date “current” to help
retain the Indian tech professionals and STEM talents within the US. The legal
immigrants should be allowed the flexibility to change jobs and travel without
obstacles. Bureaucratic delays in the US legal immigration system are holding
back the economy while leaving so many families in limbo, the Congressmen said.
Led by Congressmen Raja Krishnamoorthi and Larry Bucshon, the lawmakers urged
Biden to give the highly-skilled immigrants in the US for over a decade the
same rights to work and travel that other people enjoy by enabling them to receive
the Green Card.
About a month ago, the Biden administration had relaxed the criteria for obtaining
green card. This allows those waiting for green cards to work and stay in the
US, enhancing the prospects of Indian professionals. This also greatly helps
the H-1B holders rendered jobless in the ongoing layoffs in several companies.
The H-1B visa is a non-immigrant visa that allows US companies to employ foreign
workers in speciality occupations that require theoretical or technical expertise.
Subsequently, the US Citizenship and Immigration Services (USCIS) issued guidance
outlining the criteria for initial and renewal applications for Employment Authorization
Documents (EAD) under compelling circumstances. The USCIS may also exercise
discretion in determining the eligibility of compelling circumstances.
Permanent resident
A Green Card holder has the permission to live and work in the country on a
permanent basis. The holder, in other words, becomes a permanent resident of
the US upon receiving the card.
The US issues around 1,40,000 employment-based Green Cards to immigrants annually
with a country cap of 7%. This cap was introduced to ensure diversity of immigrants
as well as to prevent monopoly by any country.
On April 26, speaking at the US-India summit held at the US Capitol, Ajay Jain
Bhutoria, an Indian-American community leader from Silicon Valley, said, "When
we do not have a country limit on giving an H-1B visa to support our companies,
businesses and economy, why should we have a country cap limit on Green Card
issuance."
The number of employment-based green cards issued to Indians is 7,000- 8,000
per year, including dependents of primary applicants. That is, just 2,000 primary
applicants get the cards.
"We estimate that more than 8,80,000 people, including dependent spouses and
children, are waiting in the US in employment-based green card backlogs," he
said. These wait times can extend to 50 years even.
Meanwhile, the number of Indian students coming to the US on average is around
180-190 thousand per year.
The incident has triggered a debate on social media whether the officer refused to take orders from a party leader or he was accused of any corruption, some netizens justifying the handling in either case, that Ratnakar was blocking public welfare work! It is true the Govt machinery has been the enemy Number One of the people of this country, existing for itself and for these politicians, for well over seven decades. India will never make an inch of progress - real progress, not make-believe-progress - unless and until this machinery is eliminated.

PROGNOSIS: It looks a Real New Trump is emerging - courageous, balanced, powerful and disinterested. Determined to save his country from the cliff, he has done quite a few draconian things that will reduce the burden of debts of the Federal entity, like the golden handshake, stopping senseless funding, pulling out of a worthless WHO. Shutting the Education Department is another. On the other hand, running it is also not the Centre's job either (We will convincingly elaborate it in the next chapter).
In India the scene is just the opposite. Centralisation is the core agenda and identity of the ruling dispensation without which it has no existence, or in other words, it exists for that set of schemes only. A realisation of this never dawned upon any Opposition party in 2014 or any time thereafter, what to talk of being able to see it coming 70 years ago! The consequence of all this violation of basic natural law of the universe we cannot predict.
