Misleading advt: Ramdev publishes new apology in contempt of court case
In the apology, Ramdev and Balkrishna said they "un-conditionally apologise" in their individual capacity as well as on behalf of Patanjali Ayurved for "the non-compliance or disobedience of directions/orders of the Supreme Court of India" relating to the "misleading" advt case.
NEW DELHI, Apr 24: Swamy Ramdev's Patanjali published a new apology in the
newspapers in the contempt of court case on Wednesday, a day after the Supreme
Court asked whether the size of the publication of the apology put out earlier
was same as the controversial and misleading advertisements published for its
products which had led to the original petition by the Indian Medical Association
(IMA).
In the apology, Ramdev and Balkrishna said they "unconditionally apologise"
in their individual capacity as well as on behalf of Patanjali Ayurved for "the
non-compliance or disobedience of directions/orders of the Supreme Court of
India".
"Is it the same size of advertisements that you normally issue in newspapers?"
a bench of Justices Hima Kohli and Ahsanuddin Amanullah asked them while hearing
the contempt of court case on Tuesday. "Do not enlarge them and supply it to
us. We want to see the actual size... we want to see that when you issue an
ad it does not mean we have to see it by a microscope. It is not meant to be
on papers but also read," the court said.
The contempt of court had arisen following Patanjali disobeying an apex court
order in the Ayurvedic product advertisement case. The product advertisement
had questioned Allopathy's effectiveness.
Senior advocate Mukul Rohatgi, appearing for Ramdev and Balkrishna, earlier
told the court they had issued on Monday an unqualified apology for the “lapses”
on their part, which was published in 67 newspapers across the country. The
court was responding to the statement.
Following the apex court questioning whether the size of the advertisement
of apology was same as of the misleading advertisement of their products denigrating
the allopathy system of treatment which had led to the litigation, Patanjali
on Wednesday published the new, bigger advertisement of apology. The next hearing
relating to the apology in the case will be on April 30.
The text of the apology is:-
“In wake of on going matter before the Hon'ble Supreme Court of India, we in
our individual capacity as well as on behalf of the Company, unconditionally
apologise for the non-compliance or disobedience of directions/orders of the
Hon'ble Supreme Court of India.
“We unconditionally extend the apology for holding meeting/press conference
dated 22.11.2023. We earnestly apologize for the mistake made in publishing
our advertisements and it is our whole-hearted commitment that such errors will
not be repeated. We undertake to abide by directions and instructions of the
Hon'ble Court with due care and utmost sincerity. We undertake to uphold the
majesty of the court and comply with applicable laws and directions of the Hon’ble
Court of law/relevant authorities.”
The product advertisement case began when a petition was filed by the IMA (Indian
Medical Association) seeking action against Ramdev for ads denigrating the Allopathy
system of modern medicine and claiming his medicines could cure incurable diseases.
Thereafter, the Supreme Court asked Patanjali to stop all misleading advertisements
of its products for disorders specified in the Drugs and Magic Remedies (Objectionable
Advertisements) Act, 1954. However, Ramdev violated the court order and the
defamation case began.
