Mamata: Will not accept High Court order scrapping OBC quota additions

It said the Government did not follow the established laws while issuing the certificates. Five lakh OBC certificates have been cancelled by the court order. However, those who have already got employment under the quota will not be affected by the order.

KOLKATA, May 23: Bengal Chief Minister Mamata Banerjee has said she “will not
accept” the Calcutta High Court order scrapping the OBC (Other Backward Classes)
quotas. The State Government is likely to challenge the order in the Supreme
Court.
The High Court in a landmark judgement on Wednesday cancelled all the OBC certificates
issued by the Bengal Government after 2010 when the Trinamool Congress led by
Mamata came to power. The Government had distributed reservation percentages
of 10 per cent and 7 per cent to the sub-classified categories.
The court found the OBC status of several classes of people illegal. The court
said the Government did not follow the established laws while issuing the certificates.
The Sections invalidated included Section 16, the second part of Section 2(h),
and Section 5(a) of the West Bengal Backward Classes (Other than Scheduled Castes
and Scheduled Tribes) (Reservation of Vacancies in Services and Posts) Act,
2012. A petition had challenged the Act.
“Citizens from the 77 classes and 37 classes (added in the exercise of Section
16) struck down above, who are already in the service of the State, or have
already availed the benefit of reservation or have succeeded in any selection
process in the State, shall not be affected by the reason of this judgement,”
the court said.
Five lakh OBC certificates have been cancelled by the court order. Those who
have already got employment under the quota not be affected by the order.
The addition of 77 classes between 2010 and 2012, and their sub-categorisation
under the West Bengal Backward Classes (Other than SC and ST) (Reservation in
Posts) Act of 2012, were not in accordance with the law. The classification
was not based on any valid legal ground. for assessment of social and educational
backwardness. The executive orders were flawed.
A prayer by the State for a stay of the order was rejected by the bench.
Addressing an election rally in Dumdum Lok Sabha constituency, Mamata said
the Government followed the Constitution in passing the Bill and that the reservation
will continue. "We had drafted the Bill after conducting a house-to-house survey,
and it was passed by the Cabinet and the Assembly," she said.
Meanwhile, The BJP alleged that the TMC Government was giving Muslims OBC certificates
for “vote bank politics”.
