ANTWERP (Belgium), Oct 17: A Belgian court in Antwerp on Friday ruled that fugitive diamantaire Mehul Choksi’s arrest was lawful and approved India’s extradition request, marking a major breakthrough in the Rs 13,000-cr Punjab National Bank (PNB) fraud case.

In a decisive legal development, the Antwerp court validated both the arrest and extradition request of Mehul Choksi, the 66-year-old diamond trader accused of orchestrating one of India’s largest banking scams.

Choksi, who was detained by Belgian police on April 11, 2025, following a formal request from Indian authorities, now faces the possibility of being returned to India to stand trial.

The court confirmed that Choksi’s arrest met the criteria of dual criminality, meaning the charges against him—criminal conspiracy, cheating, and corruption—are recognized as crimes under both Indian and Belgian law. This legal alignment was crucial for the extradition to proceed under international treaties.

Choksi, founder of the Gitanjali Group, is a key accused in the PNB fraud case, which involved fraudulent Letters of Undertaking (LoUs) and Foreign Letters of Credit (FLCs) amounting to ?13,000 crore. He allegedly conspired with his nephew Nirav Modi to siphon funds from the bank, triggering a nationwide financial scandal.

Since his arrest in Belgium, Choksi has remained in custody, with multiple bail pleas rejected due to concerns that he posed a flight risk. The Antwerp court’s ruling now shifts the spotlight to India’s assurances regarding his detention conditions and fair trial. The Ministry of Home Affairs had earlier submitted documentation to Belgian authorities outlining jail conditions and legal safeguards to ensure compliance with human rights standards.
