UP to have special force with powers to search and arrest without warrant

UP is creating an Uttar Pradesh Special Security Force (UPSSF). The first phase will involve an expenditure of Rs 1,747 crore. The first battalion will be deployed in two weeks. The special security force will provide security to the High Court, district courts, administrative offices and buildings, metro rail, airports, banks, financial institutions, educational institutions and industrial units.

LUCKNOW, Sept 15: The Uttar Pradesh Government has passed an order to create a special force that has powers to search and arrest without warrant.

“The State Government has given orders for the constitution of a special security force. A roadmap in this regard has been sought from the UP DGP. This is a dream project of the UP Chief Minister. The basis of this force is an order of the high court, which had ordered that there should be a specialised force for civil courts. In all, there will be 9,919 personnel in the force,” Additional Chief Secretary (Home) Awanish Awasthi said on Sunday.

The new measure follows an order of the Allahabad High Court which had expressed its displeasure over the security at the civil courts last December.

Initially there will be eight battalions of the Uttar Pradesh Special Security Force (UPSSF). It will be headed by an officer of the ADG rank. The first phase will involve an expenditure of Rs 1,747 crore.

The first battalion will be deployed in two weeks.

According to a Government statement, the special security force will provide security to the High Court, district courts, administrative offices and buildings, metro rail, airports, banks, financial institutions, educational institutions and industrial units.

These policemen can search and arrest any person without the orders of a Magistrate.

The powers being given to the UPSSF are similar to the CISF, the Central force that guards similar installations, it is said. The UPSSF is a dream project of Adityanath, it has been explained.

"Any member of the force may, without any order from a magistrate and without a warrant, arrest any person who voluntarily cause hurt to, or attempts voluntarily to cause hurt to, or wrongfully restrains or attempts wrongfully to restrain or assaults, or uses, or threatens or attempts to use criminal force to any employee," section 11 of the CISF Act 1968 says.

Section 12 of the CISF ACT reads: "Whenever any member of the Force not below the prescribed rank has reason to believe that any such offence as is referred to in section 11 has been or is being committed and that a search warrant cannot be obtained without affording the offender an opportunity of escaping or of concealing evidence of the offence, he may detain the offender and search his person and belongings forthwith and, if he thinks proper, arrest any person whom he has reason to believe to have committed the offence."

The Allahabad High Court order for additional security force followed a shootout at a Bijnor courtroom on December 17, 2019. There had been several such incidents on court premises in the State in the past.
