US immigration judges told to speed up deportations: Leaked report

The move is to accelerate the mass deportation process through fast-track trials. WASHINGTON, Sept 8: The Department of Justice has issued new directives to
immigration judges during an internal training presentation instructing them
to strictly limit or slash the time granted to immigrants waiting for visa or
green card approvals before issuing deportation orders.
The policy shift has been leaked from Executive Office for Immigration Review
(EOIR) training materials. It marks a significant procedural pivot aimed at
accelerating mass deportations by cutting down on court continuances.
This directive forms part of a broader push to accelerate the mass deportation
process, The Guardian reported.
Key details of the directive
Under the new guidelines, a major procedural change is denial of routine 'continuances'—a
standard legal mechanism that grants immigrants additional time to secure legal
counsel, build their cases, or wait for pending green card decisions from other
federal immigration agencies.

Judges are directed to reject requests to pause or delay trials for immigrants
who have pending green card or visa applications processing externally with
US Citizenship and Immigration Services (USCIS).
The training also dictates that a pending visa petition backlogged by annual
statutory quotas can no longer serve as a legal justification to extend or delay
an active deportation case.
The briefing explicitly discouraged judges from granting more than 10 days
for individuals to secure legal representation before advancing court proceedings.
The directive structurally affects vulnerable groups—including survivors of
violent crimes waiting on U-visas or abandoned children eligible for Special
Immigrant Juvenile (SIJ) status—whose legal pathways to residency rely heavily

continuances, allowing the separate parts of the Federal immigration system
to sync. Under the updated mandate, the EOIR emphasizes finishing cases rapidly.
If an immigrant’s visa has not been finalized by USCIS by the trial date, judges
are pressured to conclude the court case immediately, resulting in final orders
of deportation.
Legal advocates have raised immediate due process concerns, arguing that a
hard 10-day limit to secure counsel severely undermines an individual's constitutional
right to a fair hearing given the current shortage of available immigration
attorneys.
What this means for immigrants: If an individual is in active removal
proceedings, an immigration judge handles their case. Traditionally, judges
would pause the trial if a green card or visa application was pending with US
Citizenship and Immigration Services (USCIS). Under this new directive, judges
are being heavily pressured to deny those pauses, complete the court case rapidly,
and issue final orders of deportation.
